GENERAL PROVISIONS AND SELLER'S DETAILS<\/h3>\n<ol>\n    <li>The Online Store operating at the web address <a href=\"https:\/\/mundienergy.pl\/en\/\">https:\/\/mundienergy.pl<\/a> (hereinafter the &#8222;Store&#8221;) is run by the company: MUNDI GROUP Sp\u00f3\u0142ka z ograniczon\u0105 odpowiedzialno\u015bci\u0105 with its registered office in Bielsko-Bia\u0142a, ul. Barkowska 191, 43-300 Bielsko-Bia\u0142a, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court in Bielsko-Bia\u0142a, NIP: 9372773312, REGON: 528731301 (hereinafter the &#8222;Seller&#8221;).<\/li>\n    <li>Contact with the Seller is carried out via:\n        <ul>\n            <li>E-mail address: info@mundienergy.pl<\/li>\n            <li>Correspondence address: ul. Barkowska 191, 43-300 Bielsko-Bia\u0142a<\/li>\n        <\/ul>\n    <\/li>\n    <li>These Terms and Conditions set out the rules and conditions for using the Store, placing Orders for physical food Products (functional\/energy drinks), carrying out domestic and international deliveries, procedures for withdrawing from the contract, submitting complaints, and the rights and obligations of the Seller and the Customer.<\/li>\n    <li>Before placing an Order, the Customer is obliged to read and accept the content of the Terms and Conditions.<\/li>\n<\/ol>\n\n<h3>\u00a7 2. DEFINITIONS<\/h3>\n<ol>\n    <li><strong>Seller<\/strong> &#8211; MUNDI GROUP Sp. z o.o. with its registered office in Bielsko-Bia\u0142a.<\/li>\n    <li><strong>Shop<\/strong> &#8211; the internet service at the address <a href=\"https:\/\/mundienergy.pl\/en\/\">https:\/\/mundienergy.pl<\/a>, enabling the purchase of Products at a distance.<\/li>\n    <li><strong>Customer<\/strong> &#8211; a natural person with full legal capacity (aged 18 or over), a legal person or an organisational unit without legal personality, making a purchase in the Store.<\/li>\n    <li><strong>Consumer<\/strong> &#8211; a natural person making a legal transaction (purchase) with the Seller that is not directly related to their business or professional activity.<\/li>\n    <li><strong>Entrepreneur with Consumer rights (PNPK)<\/strong> &#8211; a natural person concluding a contract directly related to their business activity, where it is clear from the content of that contract that it does not have a professional character for them.<\/li>\n    <li><strong>Product<\/strong> &#8211; a factory-packaged functional\/energy drink in a can (capacity 330 ml), available in the Store.<\/li>\n    <li><strong>Order<\/strong> &#8211; a declaration of will by the Customer aimed directly at concluding a Product Sales Contract with the Seller.<\/li>\n    <li><strong>Logistics Operator<\/strong> &#8211; Eco Service Sp. z o.o. (operator of the MagPack brand), responsible for warehousing, packing and handling the shipping of Products.<\/li>\n    <li><strong>Payment Operator<\/strong> &#8211; PayPro S.A. with its registered office in Pozna\u0144 (the Przelewy24 service).<\/li>\n<\/ol>\n\n<h3>\u00a7 3. PRODUCT SPECIFICS, AGE RESTRICTIONS (18+) AND LIABILITY<\/h3>\n<ol>\n    <li><strong>REQUIREMENT OF ADULTHOOD (18+):<\/strong> MUNDI Products contain a high caffeine content (55 mg\/100 ml, 180 mg\/330 ml) and, in accordance with applicable regulations, are intended exclusively for adults. When placing an order, the Customer absolutely declares that they are 18 years of age. The Seller reserves the right to refuse to process an Order in the event of reasonable doubt as to the adulthood of the person placing the order.<\/li>\n    <li><strong>STORAGE AND CONSUMPTION:<\/strong> Products should be stored in a dry and cool place, in accordance with the information on the label. After opening the can, the product should be consumed on the same day.<\/li>\n    <li><strong>RESPONSIBILITY FOR CONSUMPTION:<\/strong> The product should be consumed in accordance with the information on the label. Due to the high caffeine content, the recommended daily serving should not be exceeded. The product is not recommended for children, pregnant women, breastfeeding women and people sensitive to caffeine.<\/li>\n    <li><strong>PRODUCT PHOTOS AND MOCK-UPS:<\/strong> The Product photos and graphic materials posted in the Store are for illustrative purposes. Due to individual monitor and display settings and the production process, the actual appearance of the packaging or can may differ slightly from that presented on the website.<\/li>\n    <li><strong>PRODUCTION BATCHES:<\/strong> Due to the specific nature of the production process, there may be slight differences in colour shade or aroma intensity between individual batches of the drink, which results from the properties of the functional ingredients used and does not affect the quality or safety of consumption of the Product.<\/li>\n<\/ol>\n\n<h3>\u00a7 4. PLACING AND PROCESSING ORDERS (PURCHASES WITHOUT REGISTRATION)<\/h3>\n<ol>\n    <li>The Store sells exclusively without the need to register and set up a user account.<\/li>\n    <li>Orders can be placed 24 hours a day, 7 days a week via the form provided in the Store.<\/li>\n    <li>In order to place an Order, the Customer:\n        <ul>\n            <li>Selects Products and their quantity,<\/li>\n            <li>Provides the data necessary to complete the shipment (First name, Last name, Delivery address\/Parcel locker, Country of delivery, E-mail address, Phone number with country code),<\/li>\n            <li>Confirms the declaration of being 18 years of age,<\/li>\n            <li>Accepts these Terms and Conditions and the Privacy Policy,<\/li>\n            <li>Selects the delivery and payment method,<\/li>\n            <li>Clicks the button placing the Order with an obligation to pay (&#8222;I order and pay&#8221;).<\/li>\n        <\/ul>\n    <\/li>\n    <li>After placing an Order, the Seller sends an automatic confirmation of receipt of the Order to the e-mail address provided. The Sales Contract is concluded upon the Customer receiving the e-mail confirming acceptance of the Order for processing.<\/li>\n    <li>The default proof of purchase is an electronic or paper receipt. At the Customer's request submitted when placing the Order (by providing a NIP\/EU VAT number and company details), the Seller issues a VAT invoice.<\/li>\n<\/ol>\n\n<h3>\u00a7 5. PRICES AND PAYMENT METHODS<\/h3>\n<ol>\n    <li>The prices of Products given in the Store are gross prices (they include VAT) and are expressed in Polish zloty (PLN) or in another currency selected in the Store. The prices do not include delivery costs, which are given separately during the Order placement process depending on the selected destination country.<\/li>\n    <li>The Seller provides electronic payments carried out via the Przelewy24 service (PayPro S.A.), including BLIK payments, fast bank transfers, payment cards and other integrated forms of international payment.<\/li>\n    <li>The Order is passed for processing after the full payment is credited to the Payment Operator's account. If no payment is made within 3 business days of placing the Order, the Order is automatically cancelled.<\/li>\n<\/ol>\n\n<h3>\u00a7 6. DELIVERY AND LOGISTICS OPERATOR (MAGPACK)<\/h3>\n<ol>\n    <li>Delivery of Products is carried out within the territory of the Republic of Poland and selected countries of the European Union and beyond, in accordance with the list of countries available for selection in the Order form.<\/li>\n    <li>The logistics handling of the Store (warehousing, order picking and dispatch of parcels) is carried out by the Logistics Operator: Eco Service Sp. z o.o. (operator of the MagPack brand).<\/li>\n    <li>Deliveries are carried out via professional courier companies and postal operators (including InPost, DPD, DHL, FedEx or other international carriers adapted to the country of delivery).<\/li>\n    <li>The dispatch time is standardly up to 24-48 business hours from the moment the payment is credited. The expected delivery time is:\n        <ul>\n            <li>Within Poland: from 1 to 3 business days,<\/li>\n            <li>International deliveries: from 2 to 7 business days (depending on the destination country).<\/li>\n        <\/ul>\n    <\/li>\n    <li>Delivery costs are recalculated each time and indicated to the Customer in the cart before placing the Order, depending on the selected country and the weight of the shipment.<\/li>\n    <li><strong>Responsibility for the address:<\/strong> The Customer bears full responsibility for providing an incorrect, inaccurate or incomplete delivery address. In the event of the shipment being returned to the warehouse due to incorrect address data or its non-collection within the deadline, re-dispatch of the shipment is carried out at the Customer's expense.<\/li>\n    <li><strong>Receipt of the shipment:<\/strong> When receiving the shipment, the Customer should check the condition of the external packaging. In the event of finding damage to the can or the collective carton, it is recommended to draw up a damage report in the presence of the courier or to report this fact in the system\/application of the selected operator.<\/li>\n<\/ol>\n\n<h3>\u00a7 7. RIGHT TO WITHDRAW FROM THE CONTRACT (RETURNS AND EXCLUSIONS)<\/h3>\n<ol>\n    <li>The Consumer and the Entrepreneur with Consumer rights (PNPK) have the right to withdraw from the Sales Contract without giving a reason within 14 days from the day of taking possession of the Product.<\/li>\n    <li>To exercise the right of withdrawal, an unequivocal statement should be sent to the e-mail address: info@mundienergy.pl or to the Seller's correspondence address.<\/li>\n    <li><strong>EXCLUSION OF THE RIGHT OF RETURN (OPENED FOOD PRODUCTS):<\/strong> In accordance with Art. 38(5) of the Act of 30 May 2014 on consumer rights, the right to withdraw from the contract DOES NOT APPLY to contracts in which the subject of the service is goods delivered in a sealed package which, after opening, cannot be returned for health protection or hygiene reasons, if the package was opened after delivery. This means that a returned MUNDI drink must be factory-sealed, unopened, undamaged and in its original collective packaging. Opening even one can from the set excludes the possibility of returning that opened item.<\/li>\n    <li>The direct cost of returning the returned goods to the warehouse is borne by the Customer.<\/li>\n    <li>The Seller refunds payments (including the cost of the cheapest standard delivery offered for the given country) within 14 days from the day of receiving the returned, factory-sealed Product. The refund is made using the same payment method that the Customer used.<\/li>\n<\/ol>\n\n<h3>\u00a7 8. COMPLAINTS, WARRANTY AND CONFORMITY OF GOODS WITH THE CONTRACT<\/h3>\n<ol>\n    <li>The Seller is obliged to deliver to the Customer a Product free from defects and in conformity with the contract.<\/li>\n    <li>A complaint should be sent to the e-mail address: info@mundienergy.pl.<\/li>\n    <li>A complaint should include: First and last name, Order number, a description of the defect or damage, the date it was discovered and photos of the damaged Product.<\/li>\n    <li><strong>SUBJECTIVE EXCLUSION (TASTE COMPLAINTS):<\/strong> Due to the individual nature of taste perceptions, preferences regarding taste, level of sweetness, aroma intensity or degree of carbonation do not constitute a product defect or grounds for a complaint.<\/li>\n    <li>The Seller will respond to a complaint within 14 days from the day of its receipt.<\/li>\n<\/ol>\n\n<h3>\u00a7 9. LIABILITY AND FORCE MAJEURE<\/h3>\n<ol>\n    <li>The Seller is not responsible for delays in delivery resulting from reasons attributable to carriers (courier companies), customs procedures (for shipments outside the EU) or arising as a result of the Customer providing incorrect address data.<\/li>\n    <li>The Seller is not responsible for non-performance or improper performance of the contract caused by events of a Force Majeure nature (e.g. natural disasters, catastrophes, strikes, war, power outages, widespread failures of telecommunications networks).<\/li>\n    <li>The Seller reserves the right to short-term technical breaks in the operation of the Store, resulting from the need to carry out maintenance work or updates to the ICT system.<\/li>\n<\/ol>\n\n<h3>\u00a7 10. DISCOUNT CODES AND PROMOTIONS<\/h3>\n<ol>\n    <li>The Seller may make available Discount Codes entitling the holder to a discount on selected Products or delivery.<\/li>\n    <li>Discount Codes are not exchangeable for cash and cannot be combined with other promotions, unless the terms of a given promotion state otherwise.<\/li>\n    <li>A Discount Code is entered at the stage of placing an Order in the cart.<\/li>\n<\/ol>\n\n<h3>\u00a7 11. OUT-OF-COURT WAYS OF HANDLING COMPLAINTS<\/h3>\n<ol>\n    <li>The Consumer has the possibility of using out-of-court ways of handling complaints and pursuing claims, including by submitting an application to the competent consumer protection authority in their country of residence or using the EU ODR platform.<\/li>\n    <li>In Poland, detailed information is available on the website of the Office of Competition and Consumer Protection: www.uokik.gov.pl.<\/li>\n<\/ol>\n\n<h3>\u00a7 12. FINAL PROVISIONS<\/h3>\n<ol>\n    <li>The law applicable to contracts concluded in the Store is Polish law, with the reservation that the application of Polish law does not deprive Consumers residing in other countries of the protection granted to them under the mandatory provisions of the law of their country of permanent residence.<\/li>\n    <li>The Seller reserves the right to change these Terms and Conditions for important reasons.
